API Management in Europe: Sovereignty and NIS2 Compliance

API management in Europe is no longer just a technical decision. It is a regulatory, legal, and strategic one. The convergence of NIS2, DORA, GDPR enforcement, and the US CLOUD Act has created a landscape where the jurisdiction of your API gateway matters as much as its throughput. European organizations that route sensitive data through US-controlled infrastructure — even when hosted on EU soil — face compliance risks that no amount of contractual clauses can fully mitigate.

The Regulatory Landscape in 2026

European organizations now operate under a matrix of overlapping regulations that directly impact how API traffic is managed, where data flows, and who can access it. Here are the key frameworks:

NIS2 (Network and Information Security Directive 2)

NIS2, which became enforceable across EU member states in October 2024, significantly expands the scope of cybersecurity obligations. It applies to organizations in 18 critical sectors including energy, transport, banking, health, digital infrastructure, and public administration.

Key requirements relevant to API management:

  • Supply chain security (Article 21): Organizations must assess the cybersecurity practices of their suppliers, including SaaS and infrastructure providers.
  • Incident reporting (Article 23): Significant incidents must be reported within 24 hours. You need full observability of your API traffic to detect and report incidents.
  • Risk management (Article 21): Access control policies, encryption, and multi-factor authentication must be applied to critical systems — which includes API gateways that route sensitive data.
  • Management liability (Article 20): Board members can be held personally liable for non-compliance. This is not a checkbox exercise.

DORA (Digital Operational Resilience Act)

DORA applies specifically to the financial sector (banks, insurance, investment firms, payment processors) and became applicable in January 2025. It imposes strict requirements on ICT risk management.

For API management, DORA mandates:

  • ICT third-party risk management (Chapter V): Financial institutions must maintain a register of all ICT third-party providers and assess concentration risk. If your API gateway is provided by a single US vendor, that is a concentration risk.
  • Digital operational resilience testing (Chapter IV): Regular threat-led penetration testing of critical ICT systems, including API infrastructure.
  • Incident classification and reporting (Chapter III): ICT-related incidents must be classified and reported to competent authorities. API gateway logs are primary evidence.

GDPR and the CLOUD Act Conflict

GDPR (in force since 2018) requires that personal data of EU residents be processed lawfully, with adequate safeguards for international transfers. The US CLOUD Act (2018) requires US-based companies to provide data to US law enforcement upon request, regardless of where the data is physically stored.

This creates a direct legal conflict: a US-based API gateway provider hosting data in an EU data center is still subject to CLOUD Act requests. EU Standard Contractual Clauses (SCCs) and the EU-US Data Privacy Framework attempt to bridge this gap, but legal experts and the European Data Protection Board have repeatedly flagged that these mechanisms may not withstand judicial challenge.

The practical implication: routing EU personal data through a US-controlled API gateway introduces legal uncertainty that European-controlled alternatives do not.

Why Your API Gateway Jurisdiction Matters

An API gateway is not a passive pipe. It actively processes every request that flows through it:

  • Authentication tokens (JWT, OAuth2) containing user identity information.
  • Request payloads that may contain personal data (names, addresses, financial records).
  • API keys and credentials that grant access to backend systems.
  • Metadata (IP addresses, user agents, request patterns) that constitute personal data under GDPR.
  • Audit logs that record who accessed what, when, and from where.

If your API gateway is operated by a US-based company — even self-hosted — the vendor's support team, cloud management plane, and telemetry systems may have access to this data. Under the CLOUD Act, US authorities can compel the vendor to provide this data without notifying you.

This is not a theoretical risk. The Schrems II ruling (2020) invalidated the EU-US Privacy Shield precisely because of concerns about US surveillance access to EU data. While the Data Privacy Framework provides a new legal basis, its durability remains uncertain.

Deploying an open-source API gateway on your own infrastructure eliminates vendor jurisdiction concerns entirely. The software is yours. The data is yours. No vendor can be compelled to hand over what they do not have access to.

  • ICT risk register: Can you document the gateway as a managed ICT asset with known risk profile?
  • Concentration risk: Are you dependent on a single non-EU vendor for API management?
  • Resilience testing: Can you perform penetration testing and chaos engineering on the gateway?
  • Exit strategy: Can you migrate away from the gateway without vendor cooperation?

GDPR Compliance

  • Data processing location: Where is API traffic processed and logged?
  • Legal basis for transfer: If data crosses borders, what is the legal mechanism?
  • Sub-processor chain: Does the vendor use sub-processors in non-adequate jurisdictions?
  • Data subject rights: Can you delete or export API logs related to a specific data subject?
  • DPA availability: Is a GDPR-compliant Data Processing Agreement available?

The Strategic Argument

Beyond regulatory compliance, there is a strategic argument for European API management sovereignty. API gateways are critical infrastructure — they see every request, every credential, every data exchange. Handing control of this infrastructure to a non-European entity introduces geopolitical risk that has nothing to do with technology.
